A residential daycare is a home occupation that provides care, supervision or preschool instruction for children under 14 years of age within an occupied dwelling with a secured yard for direct or indirect compensation. The owner of the daycare needs to reside in the home.
*Per city code, a residential daycare cannot be located within 300 feet of an existing daycare.
- Obtain a license by clicking on the gold "apply/manage business license" box. You will either need to register an online account if you do not have one or sign into your existing account.
- Click apply and find the Home Occupation – Residential Child Day Care application, then click the blue apply tab and complete the application.
The following documents will be needed when you fill out the Home Occupation – Residential Day Care application:
*Department of Commerce name registration (only if using a business name)
*Day Care Inspection form
*Property Owner Authorization form (only if your name is not on the title of the home or if you rent)
*State License – Mandatory for over anyone watching over 8 children (including their own)
*Background Check (from every adult over 18 that resides in the home) dated within the last 6 months. Background checks must be from the state where your ID was issued. For Utah, background checks can be obtained from BCI, 4317 S. 2700 West.
*Copy of Identification (driver’s license or state issued ID card)
*Photos of the outdoor play area and fencing to show compliance with:
A secure outdoor play area is required for all residential child day care home occupations and shall comply with the following:
a. The play area shall be located in the rear and/or side yard of the dwelling.
b. The play area shall be secured by a well-maintained fence that is at least 6 feet in height with a self-latching gate.
c. The outdoor play area shall be maintained in good condition and be finished and landscaped to include ground covers, paving or other surfaces that do not pose a risk to children.
d. The outdoor play area shall not be used by the residential child day care before 8 a.m. or after 8 p.m.

For residential child day care, residential preschools, and residential instruction, drop-off and pick-up shall not occur in the public right-of-way.
