Small Claims Court
Small claims court hearings are now in-person only.
If any parties have concerns, conditions or any other situations that will prevent them from appearing in-person such as residing out of state, please fill out this form to request a hearing over Webex.
Parties are to appear for the hearings in-person unless they have submitted a motion and it has been granted.
Small claims cases are civil actions to recover money only; claims must be for actual damages (treble damages cannot be awarded). Small claims cases cannot be used to sue government entities, for possession of property or eviction.
Small Claims jurisdictional limits are set by the Legislature per Utah Code Section §78A-8-102. Cases can be filed for a claim up to $15,000 excluding court costs and service fees. A small claims case must be filed in the Justice Court where the defendant resides or where the claim arose. Taylorsville Justice Court only has jurisdiction over Taylorsville City and does not preside or have jurisdiction over any other locations.
Filing Fees are set per Utah Code Annotated §78A-2-301:
Claims $2,000 or less: $60.00
Claims $2,001 to $7,499: $100.00
Claims $7,500 to $15,000: $185.00

Please note that failure to comply with the rules may result in dismissal of the case.
After the case is filed with the court, the plaintiff (person filing the claim) is responsible to serve the defendant notice of the suit.
